General contract law is a central part of business law. General contract law is largely unenforced in Norwegian law and is regulated by the so-called background law, which will apply unless the parties have agreed otherwise. It is therefore important to have clear agreements that regulate what the parties want to apply to the contractual relationship. We have a good commercial understanding, which is an advantage during negotiations and drafting contracts.
Many areas of contract are nevertheless regulated by law, e.g. agency law, disposal of real estate and employment law. For such contracts, the parties’ freedom of contract is typically more limited than if only general contract law applies.
